On Accidents and Negligence in the Construction Site

Working on a construction or repair project can be dangerous, especially for workers. Because of certain hazards that are linked with working in such an environment, construction employers play a huge role in implementing certain standards. These standards would ensure all those involved in the project that the working environment is geared towards safety.

Construction industry professionals like contractors, subcontractors, engineers, surveyors, and project managers all possess a duty of care towards the laborers. Along with the establishment of a master plan for a building or repair project, they are tasked to make risk assessments on all aspects of construction. The professionals must make sure that the workplace is safe and would not increase the chances of laborers' losing their life and limb.

Accidents still happen

Unfortunately, the construction site is one of the main venues for workplace accidents. One certain type of accident that happens in such a venue involve falls from elevated surfaces like ladders and stairs. Other accidents occur because of certain failures in the implementation of safety measures. These include improper installation of scaffolding and use of dangerous tools and unsafe machinery, among other issues of hazard.

Having improper establishment of safety precaution would mean that construction workers are at risk of getting seriously injured. They could also die either on the spot or after succumbing from injuries because of the said hazards. Deaths among construction workers accounted for 15 percent of all job-related deaths in the United States, according to the Bureau of Labor Statistics (BLS).

Negligence in the construction site

Injuries and deaths in the construction site may not have happened if not for the lack of duty of care of any professional responsible of the project. Therefore, the injured worker or the family of the worker who died in the construction site has the right to file a personal injury lawsuit against the ones in-charge of the project on the basis of construction negligence.

In establishing construction negligence, the injured party or the family of the decedent needs to prove in his or her lawsuit the following:

• People in-charge of the construction have a duty of care towards their workers;• They violated that duty of care; • The violation of the duty of care resulted in the injury or death of the worker; and • The injury or death of the worker was the result of the negligence of the people in-charge of the construction project.
