Getting a Visitor Visa From the USCIS

April 24, 2012 | Comments: 0 | Views: 79

The United States is always on the wish list of people who love to travel. But traveling to the U.S. is not very easy. There are several rules and regulations you may have to follow to enter the U.S. The first thing one has to do is to check the USCIS website in order to understand what they are required to do in order to visit the U.S.

The USCIS has a set of guidelines for visiting travelers. Every traveler is required to submit the information requested in the form DS 160 accurately in order to get a visitor's visa. However, some countries are exempt from this requirement. There are several categories under which you may apply to get a visa to enter the U.S. If you want to travel to the U.S. for reasons other than business or pleasure, you may have to apply in that particular category. For instance, if you are a journalist, or a crewmember you may have to choose the right category for applying. The USCIS website will help you determine the right category.

After identifying your category of application, you should read the rules and regulations and guidelines properly before beginning to fill it up. You should also find out all the documents you are required to submit. Do not submit the original documents. Submit copies of the documents required. You may be required to show the original during the time of interview.

When the Customs and Border Protection (CBP) allows you to enter the U.S. at the designated port of entry, you will receive a stamped form I-94. The I-94 is a record of your arrival and departure. If you want to stay beyond the time stamped on your I-94, you can apply to extend your stay. For this you may have to fill form I-539 with the USCIS. If you happen to lose your I-94 you have to apply for a replacement. For this you may have to fill out form I-102 (Application for replacement of nonimmigrant arrival and departure record.)

If you want to extend your stay you may apply for it if:

1. You were lawfully admitted with a nonimmigrant visa. 2. Your nonimmigrant visa status is valid. 3. You have committed no crime that will make you ineligible for visa. 4. You have not violated any conditions of admission. 5. Your passport is valid until the duration of your stay.

However, you may not be eligible to extend your stay if you had applied under the following categories:

1. Visa waiver program 2. Crew member 3. In transit through U.S. 4. In transit through the U.S. without a visa. 5. Fiance of a U.S. citizen or dependent of a fiancé 6. Informant on terrorism or organized crime.

If you require further information on visiting the U.S., you may visit the USCIS website and browse through the categories, processing times, interviews etc., to get an idea of how to apply.

The website also gives you the information on the fees you are required to pay along with your application. During the interview you may have to show the receipt you received, showing that the visa-processing fee has been paid. If the USCIS is not satisfied with any information that you have provided, your application may be denied or rejected.
