Overview of DUI Laws and Penalties in Phoenix

Being arrested with a DUI charge is never without its harsh penalties, no matter where you live. However, getting a DUI charge in Phoenix can be classified as either "standard", "extreme" or "super-extreme". Its classification depends on earlier DUI's and your blood alcohol concentration (BAC) at the time of your arrest. The breakdown is as follows:

DUI Penalties for Standard Convictions:

If you are convicted of your first DUI offense, you are looking at a mandatory jail stay of 24 hours, and that can be extended to as much as 10 days in jail. In Phoenix, it will carry a fine that can range up to $1,800, having your driver's license suspended for 90 days and up to five years probation. If you pick up another DUI charge with 10 years of the first one, the penalties will be more severe. These include a mandatory jail stay of 30 days, up to $3,500 in fines and having your license revoked for one year.

DUI Penalties for Extreme Convictions:

To be charged with an extreme DUI offense in Phoenix, your BAC would have to be in the 0.15 to 0.199 range. This time, you are looking at a mandatory jail sentence of 10 days, up to $3,000 in fines, having your license suspended for 90 days and, at your own expense, an ignition interlock device would have to be installed in any vehicle you drive. Of course, it goes beyond saying that any additional convictions for further DUI's would constitute more serious penalties.

DUI Penalties for Super-Extreme Convictions:

In Phoenix, you will be charged with a super-extreme DUI if your BAC was over 0.20 at the time of your arrest. You face being charged with the most serious of DUI offenses when your charge falls into the super-extreme category. This is the charge that carries the harshest penalties of all including a mandatory 45 day jail stay, fines that can range up to $3,250 and your driver's license will be suspended for a minimum of 90 days. If you happen to be charged with another super-extreme offense in Phoenix within 10 years of the first one, you are looking at a mandatory 180 day jail stay, your license will be revoked for a year, you could be fined up to $18,000 and you will be required to perform a minimum of 30 hours of community service.

if you are found to be driving drunk with a child under 15 years of age in the vehicle, you face additional fines of $750 for the first, second and third offense. When you combine that fine with any of the above convictions, you can clearly see that DUI carry stiff penalties, which are not to be taken lightly.

Drivers with a blood alcohol concentration (BAC) of.08 or higher, or those with a (BAC) of.04 or higher who are truck or bus drivers, face very harsh penalties as mentioned above. Young drivers, those under 21 years of age, may not drive with any amount of alcohol in their system.
