Renters Take Note: Why Your Condition Report Is So Important

What is a Condition Report?

At the start of a new lease, you will need to fill out along with the lease agreement what's called a 'Condition Report'. This gives you a chance to take note of the overall condition of the property going room to room, checking fixtures and fittings to making sure you don't miss anything that's either damaged, dirty or out of place. If there is any damage to the property, marks on walls, broken taps, stains on carpets etc filling in the condition report in detail can possibly save you hundreds if not thousands at the end of your tenancy. According to the Tenants Union ACT Inc: 'The condition report will be a main piece of evidence that will stand up in court should the landlord/agent file a claim for damages'.

Why Filling in the Report in Detail is So Important

Before you move into any rental property a condition report must be completed. By law, you should receive 2 copies of the report once you sign a lease agreement. You have up to two weeks (in some countries) to return 1 copy to the agent. Take your time filling out the report in detail and by any means don't feel pressured by the agent to fill it out in a hurry.

Remember, if you don't agree with any of the report make sure you add you own comments and don't forget to sign or initial. You can apply to the correct legal bodies: Trader, Consumer, and Tenancy Tribunals for the comments to be amended if you don't agree with any of the notes written by the landlord or agent on the report. Store the condition report for safe keeping with all the other important documents that you have received i.e. the lease agreement, bond form etc.

The more detailed the report, the better

Thousands of agents and landlords have used simple and 'lack of detail' reports to claim for damages against tenants/renters so take your time to fill out the condition report in detail. Another important point is to take photos or even videos while doing the inspection/condition report. As they say 'a picture is worth a thousand words' and this covers you even more so should the landlord make a claim for damages at the end of your tenancy.

If by the odd chance you haven't received the condition report by the agent/landlord, you should record this and notify the landlord/agent in writing. There are a number of websites that you can visit to download your own condition report however these are different all over the world so make sure you check with the correct legal bodies beforehand. If the landlord or agent fails to produce a condition report at the end of your lease and wants to claim for damages, the judge will most certainly rule in your favour.

In conclusion...

I've seen a number of tenants lose their entire bond money due to the fact that they've failed to store a copy of the condition report in a safe place. Agent's will jump at the opportunity to have items replaced and properties cleaned at the tenant's expense which is why it's so important for renters to take the condition report seriously. It's a legal document that will stand up in court should any problems or claims arise at the end of your lease.
