Probate laws of a state govern the process of distributing the property of a person after he/she is dead. There is a separate segment of lawyers which specializes in dealing with such cases and helps in the distribution of this property. They are called the probate lawyers and have specialization in probate laws. It is not very difficult to find a probate attorney but it requires some effort to find the right attorney for your needs. You need to plan and research a little in order to find the right lawyer.

Mentioned below are some tips that will help you in selecting the right probate lawyer:

  • Find out your exact requirements: Probate cases can be of many types and you have to evaluate your needs in order to find the attorney who is most suitable for your case. Your needs will help you in determining the best attorney for your requirements. For example, a particular lawyer might be a better choice in case you want to set up a trust to protect your assets whereas, the same attorney may not be the best choice when you want to challenge a will.
  • Search and make a list of lawyers: Try to find a lawyer through a reliable source such as friends, family or an attorney whom you know well. Further, you should also get the names of probate attorneys who practice in your area. As probate cases are dealt at local level and are presided over by local judges therefore make sure that you get a local lawyer who knows fine details and particulars about local judges.
  • Create a set of questions: You have to make sure that the attorney has good experience of dealing with cases similar to yours. You have to be a little prepared for this task. Draft a list of questions that should be aimed at gathering the information such as their experience, time spent in that area and their views on your case. Further, you should not hesitate in asking about fees charged by the lawyer. Most of the clients refrain from such questions and end up paying heavily for things that they did not even think of. Further, also find out how the payment is done. Is it hourly basis or flat case based?
  • Talk to them: The best way to determine whether a lawyer is good enough for your case is by talking to him. It would be better if you called each attorney and fixed a date and time to meet them. However, you should remember that attorney are usually very busy therefore you need to make it clear that you are a potential client looking for a suitable lawyer to represent the case and not just seeking legal advice for the case.
  • Inquire about the chosen attorney from your state bar association: By now you must have narrowed down the list to one or two attorneys. Before you finalize the attorney and offer your case to him, just contact your state bar association to make sure that he has no work ethics violations. An ethics violation does not means that the attorney is not good but it is better to talk to him about it beforehand.
