Have You Had A Misdiagnosis of Testicular Cancer?

February 26, 2012 | Comments: 0 | Views: 152

Testicular cancer is a form of cancer that can be located in either or both of a man's testicles. Also referred to as the testes or the gonads, the testicles are located in the scrotum that is a sack like area found under the penis.

Part of the male reproductive system, the testicles are slightly smaller in size than golf balls. They are the main source of important bodily hormones for the man, most notably testosterone, and they also are the area that produces sperm.

There are many different cells that can be found in the testicles, as well as the surrounding area. Any of these cells at any time can transform into cancer. Over ninety percent of all testicular cancer cases start off in the cells called germ cells. There are two main types of germ cell tumors: seminomas and nonseminomas. Seminomas account for about forty percent of all cases of germ cell testicular tumore and are often found in men between the ages of twenty five and fifty five. Nonseminomas are a category of tumors that include yolk sac tumors, choriocarcinomas, teratomas, and embryonal carcinomas.

Unfortunately, testicular cancer is the most commonly occurring type of cancer in younger men aged fifteen to thirty five. While this may sound a bit shocking, it is important to note that this disease comprises less than two percent of all cases of cancer in men. It is also necessary to understand that testicular cancer has a high curability rate. That being said, the two main types of testicular cancer are often overlooked and/or commonly misdiagnosed.

For the majority of cases of testicular cancer, the most typical symptom noted is swelling, which may or may not be associated with pain. The area may be tender to the touch, may have a slight ache, and one testicle may have a somewhat heavy feel. Other patients report their first symptoms as a cough, a back ache, or a stomach ache. A cough usually develops only after the cancer starts to spread throughout the patient's body. If all of the necessary medical tests are not completed, or a medical professional does not conduct a full physical examination, medical negligence may have occurred. Because symptoms of testicular cancer can be somewhat vague in nature, it is not uncommon that the disease is dismissed as a condition that is far less serious, or that it is completely missed. In order for a proper diagnosis to be made, a complete physical examination is needed, as well as a biopsy, an ultrasound scan, and in some more severe cases, surgery may be required.

The patient has the best possible chances for recover from testicular cancer when a prompt and correct diagnosis is made. If there is a delay in the diagnosis for any reason, or if a total misdiagnosis has been made, you may be able to seek recourse through the legal system. Legal claims are filed in a court of law, and work to provide the injured party with some form of compensation for the injuries that have been sustained. Regrettably, there are times when the patient does not survive, and is not able to pursue a legal claim himself. When this happens, the surviving family members may be able to file a claim on behalf of the decedent, and may also be able to file a wrongful death claim as well.

Obtaining a diagnosis of testicular cancer, or any form of cancer can be truly devastating. With this diagnosis comes a great deal of fear, anxiety, and in some cases physical pain. While this can be very difficult to deal with, and it may be the last thing you want to hear, getting such a diagnosis in a prompt fashion can make all the difference for your chances of survival. Acting promptly can mean that a treatment plan can be designed, which will work quickly to kill the cancer cells in the body and/or keep them from spreading to other areas. When this is not done patients can needlessly suffer, and may even risk the possibility of not being able to treat the disease effectively or at all.

If you or someone you know has been harmed because of a misdiagnosis of testicular cancer, you should not wait to contact a personal injury attorney for assistance. Since different states have various statutes of limitations, delaying the filing of your claim can end up costing you a great deal in the long run. In fact, missing certain details when filing, or filing to late can cause your claim to be dismissed completely, which means you will be left with no recourse at all.

Since most personal injury attorneys work on a contingency basis, you never have to worry about how to fund your claim as it progress through the system. This will provide you with a great deal of comfort knowing that a professional is handling all of the details on your behalf, while you take the time needed to focus on your personal recovery.

Personal injury attorneys will handle every aspect of your case, from start to finish. He or she will collect all of the necessary evidence, arrange for reports to be filed, and even arrange for expert testimonials if need be. These professionals know this area of the law in and out, and will work hard to get you the compensation you deserve. Not only will you be taking action to help yourself, and your family, you will also be taking steps to ensure the same mistakes are not made to innocent people in the future. Compensation can be awarded for past, present, and future medical bills, lost income, and even pain and suffering.

You should not wait to contact a personal injury attorney and get the ball rolling on your claim. Medical professionals have teams of lawyers working hard to protect their interests and so should you. There is no reason to suffer in silence, or allow negligent behavior to go on, unpunished.
