Claiming Compensation for Gynaecological Medical Negligence

Gynaecology can be an embarrassing process for many women, and one that enough women avoid that there are entire advertising campaigns aimed at getting women to see their gynaecologist. Given the sensitive nature of gynaecology, it's imperative that any procedure is carried out by a trustworthy professional.

Whilst most gynaecologists excel at their work and proceed in a sensitive manner considerate of their patients, it remains a fact that gynaecology makes up over half of medical negligence cases. Claiming for negligence in this sort of case can seem embarrassing, but it is vitally important to get the compensation you deserve if you have suffered.

A great deal of medical negligence cases pertaining to gynaecology are based on misdiagnosis. This predominantly involves misread smear tests that lead to further complications down the line. One case that illustrates the severity of gynaecological medical negligence saw a woman develop cervical cancer and eventually lose her fertility as a result of an incorrectly reported smear.

Cases in the field of gynaecology can also involve complications from surgery, terminations or contraceptive procedures. More or less any procedure that you feel has led to a loss in the quality of your life should be pursued, even if you feel that it isn't necessary.

Pursuing a case

Although pursuing a case based around such a sensitive area of medicine can seem embarrassing, it's important not to feel that way. Most solicitors will have female staff who have dealt with similar cases in the past and will provide an understanding ear for your complaint. Medical negligence solicitors, given the sensitive nature of the cases they deal with, also insist on total confidentiality, meaning that any case will be solely between you and them.

Claiming compensation rests on three things; firstly, you have to prove you received the wrong treatment and have suffered as a result. After this, you need someone to claim from. This will generally be your local NHS trust unless you are with a private healthcare provider. Finally, you need to produce evidence of your injuries.

Generally, a good medical negligence solicitor will deal with all of the above aspects for you, including obtaining medical reports and proving that the level of care you received fell below standards. You have a three year period in which to claim after your injuries; although it's advisable to claim as soon as possible whilst medical reports are still readily obtainable.

If you feel like you have been the victim of gynaecological medical negligence, then it's definitely worth calling up a solicitor and discussing your case. The sensitive nature of such cases can seem embarrassing but it's vitally important not to be afraid to speak out; in the case mentioned earlier in this article, the woman involved was awarded £365,000 after it was proven her fertility could have been saved with quicker treatment. There's no replacement for good health, but never be afraid to claim for the compensation you deserve.
