How to Tell If Your NZ Lawyer Is Qualified

Lawyers in New Zealand are in high demand, as they are through the entire Western World. Ranging from criminal to civil applications, with many specialisations in between, lawyers are required to ensure even the most simple of transaction or agreement is created in due course, with reference to the current legislation. From criminal cases that receive media attention to the creation of wills and transfer of property, al New Zealanders will require the services of a lawyer; and for most people or families, this will be much more often.

It is important, however, to ensure the law firm or specific lawyer engaged and hired, is suitably qualified and experienced to complete the task at hand to the highest level. Any mistakes on the part of the lawyer could mean financial loss or worse for those being represented. In New Zealand, lawyers have to go through a rigorous training and accreditation process before physically entering the legal system. This includes a thorough university education, where a pre-requisite for the admission to practice law is the completion of four year law degree. As well as compulsory and elective papers depending on the specialisation, papers in ethical conduct and practice must also be passed.

The New Zealand Counsel of Legal Education requires all those who have the necessary tertiary qualifications to additionally complete practical legal training. This process ensures that junior lawyers have the necessary practical abilities to complete the daily duties expected of a lawyer. There are several options where junior lawyers can complete their practical requirements, by completing a professional legal studies course or by undertaking articles of clerkship. The professional legal studies course involves a course between 13 and 15 weeks in duration that focuses on competency based skills. Articles of clerkship are a legal term used to describe an apprenticeship style position, whereby graduates work for a 12 month period with a practicing law firm.

Upon successful completion of either of the two options described above, the graduate may apply for a Certificate of Completion. This award, along with a certificate of character, is then lodged with the Law Society and admitted to the High Court in New Zealand. The final stage is obtaining the practicing certificate from the New Zealand Law Society.

To ensure that you are being represented by an experienced and qualified lawyer in New Zealand, ensure that they have the relevant law degree and are registered with the Law Society.
