When Can You Claim Free Land?

Free land is something that exists everywhere. We just need to look around and find the same. This article talks about the various aspects of claiming free land.

If you think claiming free land or property is a new concept which is being practiced in recent times, then you are wrong. This has been going on since time immemorial and you could find examples of this from your history books.

Going back to history for a good example, one can talk about the new settlers who had come to America and claimed the free land as their own and went ahead by building homes and farmlands on it.

Returning to the present, it can be safely said that there are countless vacant and unclaimed plots of land lying around unused and unregistered that can be claimed by common individuals like you and me.

The first and foremost step towards claiming free land or property is the identification of the plot to stake your claim on. Since you can't call anything and everything that you see as your own, being selective and undergoing a bit of detective work thereafter work well in this property identification phase.

An unwanted or unclaimed property always possesses some sure signs which you need to be able to observe and identify. Such sure signs include broken or boarded-up windows, overgrown gates and gardens, derelicts, unused garages, empty tracts of fields or shrub lands, or unused and abandoned industrial buildings and commercial premises.

Driving around your neighborhood will not help since there's high chance of missing these subtle and non-obvious signs of unclaimed property. Walk around your neighborhood for spotting these signs.

Once your identification is done, registration check is the next step for you. Contact the Land registry to know whether the plot of land is already registered, unregistered or is in the pending first application status.

If the plot is already registered there might be many reasons behind it. The owner could have died without leaving any relatives behind. Or it may be that the relative do not want the land or may be the owner has moved abroad abandoning this property.

Firstly, if it is registered this could mean a number of things like the owner has died and had no relatives, the relatives may not be interested in their share of the land or property or it might be that the owner may have just simply abounded it and moved abroad.

Coming to the third instance of the land being in the 'Pending first Application' mode, it's better to let go of this and search another free plot of land instead since someone else has already beaten you to it and claimed it first.

Once, you have checked the registration status of the promising piece of land, you need to trace its original owner next as because you will be asked to provide evidence of having contacted the person while you go ahead to stake a claim on any land.

A helpful hint would be to go and ask the neighbors first. Remember that immediate neighbors would know the most about the owner. Other parties include the local post office, electoral rolls, milkman, landlord, news agents and in some cases the probate registry office (for instances where the owner is dead).

When you are ready for the claim, make sure you draw up a document and arrange for two witnesses in order to keep evidence of the claim start date. This document is not compulsory and you might ask your friends or colleagues to sign as witnesses.

Remember, putting up a 'No Trespassing' sign or even a small fence around the plot are good and end effective ways to quickly bring back any owner who might exist for the land.

You can make money while the long claiming period gets over. This period can even go up to 10 or 12 years and what you can do in between is either rent out the land or hold events like boot sales and the like.

Most likely your answer is no, and so the people who would help you the most are undoubtedly the immediate neighbors of the plot of land.

Infact, there exists numerous websites who would undertake the detective for you in finding out the whereabouts of the original owner.

Thus, you can use all these things mentioned above in order to claim a free plot of land for yourself.
