Preparing for an OFCCP Audit

Preparing for an audit conducted the Office of Federal Contract Compliance Programs is very important to ensure you will retain your status as a federal contractor or subcontractor.

The mission of the OFCCP is to ensure that employment opportunities generated by federal dollars should be available to all Americans on an equitable and fair basis. They monitor affirmative action efforts and mandate that in hiring practices federal contractors and subcontractors cannot discriminate on the basis of race, color, religion, sex, national origin, disability, and protected veteran status.

The OFCCP conducts 4,000 to 10,000 audits on an annual basis. You could be one of those audits, so it's important to always be prepared.

The audit will include a review of personnel and hiring practices of federal contractors and subcontractors and deem whether or not appropriate efforts have been made. The OFCCP will take special care to ensure contractors are abiding by Executive Order 11246, as amended; Section 503 of the Rehabilitation Act of 1973, as amended; and the Vietnam Era Veterans' Readjustment Assistance Act of 1974, as amended, 38 U.S.C. 4212. These are the three main laws the OFCCP protects. They also ensure compliance with Executive Order 13201.

First you must determine if you are a government contractor or subcontractor that falls under the regulations. Typically it is those organizations with 50 or more employees in a 25 mile radius, who have a contract of $50,000 or more in federal funds. Subcontractors are typically providing goods or services to a prime contractor.

Next you must always maintain and collect personnel data properly. This includes ensuring race and gender is collected and that EEO-1 codes are accurate.

You must also maintain applicant flow records. Each applicant that applies for a position at your company must be defined and documented. Their demographic should be collected and placed in a system where a report can be generated. There are various methodologies and strategies for tracking this based on systems and processes within your organization.

Take a look at compensation equity between men, women, minorities, and non-minorities in similarly situated positions. You'll need a business argument for differences in salary.

Next EEO-1 and Vets 100 reports need to be filed timely each year. AAP goals must be communicated to recruiters and hiring managers and an outreach strategy should be developed.

When you are notified that you will be audited, you'll need to prepare for the desk audit. Review your AAP to assure accuracy and perform a mid-monitoring of goal attainment. You should also provide employment activity reports.

You should run adverse impact reports for hires, terminations, promotions, and applicant flow prior to sending in your desk audit submission. Review salary equity analysis to defend salary disparities and pinpoint any areas of concern.

During an on-site audit an auditor will come to visit your company. Before the visit occurs, tell your management team that the auditors are coming. Hold meetings so they know what to expect. Ensure all compliance posters are on the walls and up to date. Also have I-9 files ready to be reviewed.
