Few Ways to Fight Deportation or Removal

April 04, 2012 | Comments: 0 | Views: 135

Within the last year the number of deportations has significantly increased in the United States of America. With the new changes in federal immigration laws in the USA, it has become much harder to fight deportation. It can be much harder on immigrants who have had any prior legal criminal convictions. The odds of winning your deportation case can be significantly bolstered with the help of deportation lawyers. This is especially true for those who have deep family ties within the United States and those who have had a long residence history in the US. The first step you should take is to contact a few USA deportation lawyers and to research the plethora of ways to avoid deportation. If you have received notification from the Department of Homeland Security to appear before an immigration judge you will need to respond accordingly. Here are a few ways deportation lawyers and you have at your disposal to help you fight back against deportation or removal.

1. Asking For a Delay and To Seek Asylum

When you have contacted your list of deportation lawyers they can only help you seek Asylum if you have a real fear of returning to your homeland such as a fear of being persecuted by your country men with bodily harm or death.

2. Leave The US Voluntarily

For most non US citizens this is not a valid option but for many it is a way for their lawyers to "buy time" for such reasons as waiting for a spouse to naturalize into a permanent citizen. If this is the case for you it would also make you an immediate relative and there for would make you a full US citizen as well.

3. File For A "Cancellation of Removal."

This avenue does have stipulations such as you must have been in the United States for years with a good moral standing. It would also behoove you to have an immediate family member that is a legal US citizen that could attest to the fact that if you had to leave the United States it would cause a hardship to them financially.

4. Challenge The Grounds For Deportation

Your deportation lawyer will now have the opportunity to challenge the grounds of your deportation in front of an immigration judge. If for instance you are being deported because of a crime committed and you have not been in any criminal proceedings for a number of years you can challenge the grounds for deportation.

This is by no means an exhaustive list as there are many ways that a deportation lawyer can fight on your behalf. The immigration laws are federal and are ever changing, so you should contact a good deportation lawyer to help with all facets of your deportation case.
