An Introduction to Workers' Compensation

Over the course of employment at a company, a worker is sometimes entitled to what is termed workers' compensation in the case the worker should need medical care for an injury that occurred on the grounds of their workplace or while on the job elsewhere. A worker is guaranteed a certain level of coverage by their employer, although this coverage does vary according to the area the employer is in. There are specific pros and cons to workers' compensation as well, which this article will delve into.

In the event the employee is awarded their compensation, they will generally receive workers' compensation in weekly payouts as a substitute for their salary, often at a rate of 2/3 their original salary. As one might expect, hospital expenses are covered also including the emergency mobilization. Workers' compensation acts as a health insurance policy and disability insurance policy in conjunction. Sometimes, it also acts as a life insurance policy. For example, if the employee faces death on the job, their dependents will receive compensation. Two areas which are excluded from workers' compensation are general damages for pain and suffering and punitive damages.

Workers' compensation pays out largely if the employee is still able to actively seek out other employment. An example situation would be one where an employee injured both his legs and is wheelchair bound. He could still potentially find other work almost immediately after his recovery as long he has the necessary skills to do some other type of work. He may wish, however, to stick with the company he is already with. Perhaps it is close to his home, or he has made close friends there, or he really feels at home in the atmosphere. The injured employee may request that the employer in this case alter his duties to accommodate his new found limitations. He may ask to be placed on what could be termed 'light duty' so that he could stay with the company while doing the most he is able to do. One of the negatives for employees in workers' compensation plans is that they cannot always downgrade to what is considered 'light duty' if the corporation they work for does not offer this type of employment.

Many new additional features have been proposed for worker's compensation laws, but they haven't yet been implemented by the legislatures of all areas. These features are designed to protect the worker from exploitation. The best someone can do at this point is have an experienced attorney work with the existing laws to help you win your case. As you can see, workers' compensation is a very good thing for an employee. It protects them from a variety of problems they may face while loyally working for an employee.
