Free Power of Attorney

Why pay for a Power of Attorney Form when you can get it free? You have websites on google, bing, and yahoo advertising hard so that you never get a hold of one of these free forms. First we should ask ourselves, What is Power of Attorney? It is a legal document that transfers power from one person (typically called the "Principal") to someone else ("Attorney-in-Fact") for broad or specific uses. There are FOUR types

Durable - Allows you to transfer "all financial powers permitted by law" to someone else. The form stays valid if the principal should become incapacitated which is described as a licensed medical person stating they cannot make mental decisions for them self. General - Allows you to transfer "all financial powers permitted by law" to someone else. The form becomes void if the principal should become incapacitated which is described as a licensed medical person stating they cannot make mental decisions for them self. Limited - Allows you to transfer a specific power to someone else. The form becomes void upon the task being completes, and if the principal should become incapacitated before the task has been completed. Medical - Allows you to transfer all medical decision making to someone else in the event your should become incapacitated. The form becomes void upon the death of the principal.

There are three major ways to cancel anyone of these forms.

1 - Get rid of the evidence, just destroy all the documents you created, and it doesn't exist.2 - Sign a new form, a new one always makes the previous void.3 - Authorize a power of attorney revocation form.

There are three major requirements when authorizing the form.

1 - All persons signing must be at least 18 years old.2 - The principal must sign with a notary present.3 - The attorney-in-fact must sign with the notary present.

Living Will vs Medical Power of Attorney? A living will is a legal document that allows you to state your medical treatments if you should become in a vegetative state with no known cure to your doctor. So, basically the main difference is under a medical power of attorney form you are allowed to choose anyone of your choosing your medical treatment care. Whereas under a living will, you are entrusting your doctor, which may be a good person and all, but can also treat you against your family's wishes. So, would you rather have a "trusted person" look after your medical needs, or, a doctor running from room to room?
