Long Term Disability Benefits Horror Stories

Have you been experiencing trouble and frustration regarding long term disability benefits? Getting the run around or the silent treatment? While certainly no consolation, don't feel alone. Take the Florida accountant who discovered he suffered from Multiple Sclerosis. Being the sole-provider for his family and grandchild, he began to become extremely concerned when continuing with his paying job seemed impossible.

Fortunately the gentleman paid into long-term disability through his employer. Everything would be taken care of. Or so he thought.

Instead of heeding the medical advice of 11 doctors, this particular insurer decided to enlist their own specialist who promptly deemed there was insignificant medical evidence that the tests performed by those previous doctors indicated conclusively for a diagnosis of multiple sclerosis.

All 11 of those doctors had seen the patient. They had taken the time to exam him. They all came to the conclusion the man suffered from an increasingly expanding case of MS.

But the insurance company doctor felt otherwise. This of course might make sense had this medical professional also taken the time to see the patient in question. To exam him thoroughly.

The rub, however? This doctor never visited with the patient. Never set eyes upon him. Never performed any sort of physical examination.

Yet, based upon his written report and signature, the insurance company refused approval for the patient's long term disability benefits!

At the same time, the insurer also did not deny the benefits request. Instead, as so many experience, the gentleman faced the ongoing unknown status of his financial fate. It wasn't until one very sensible act occurred that provided some insight into this case.

A long term disability benefits attorney began working on the case and discovered some interesting documentation in the insurance company file for this individual.

In it, a report by the aforementioned doctor, working directly for the insurer, stated he felt no supporting proof for the diagnosis of Multiple Sclerosis and the former account could perform "sedentary" work.

The man was an accountant. Taking absolutely nothing away from the profession of accountancy, how much more sedentary work might one imagine? Perhaps professional television watcher working for a ratings firm? Perhaps.

Only when the benefits attorney arrived and knew the client's legal rights did they have a chance to discover the farce being perpetrated by the insurance company. Once they received the documents and found the reports by the doctor who never examined the client, a defensible position could be mounted.

On this specific case, the help of a nationally syndicated morning television news program helped, or seemingly helped, to pave the way for the insurance company finally making an approving decision to pay benefits to the disabled former worker.

As one might imagine, the insurer officially denied the negative publicity stirred up by the case appearing to a national audience affected their decision to authorize payments in any way.

While the truth of that may never be ferreted out, one take away is certain--without the help of the experienced and talented long term disability benefits attorney, the chance of discovering why the withholding of approval may never have come to light.
