How to Divide a DUI Client Folder Into Sections That Transfer Easily Into a Trial Notebook

As a DUI Attorney its important to stay organized in a manner that easily transfers from pretrial to trial. Meaning all of the discovery, interview notes of the officer, an interview of the defendant, pretrial motions should be kept in an organized manner that can easily be plugged into a trial notebook for a jury trial. This method of organizing all of these documents starts with the legal file folder that should be kept for every client.

For those of you that don't know every client should have their own file folder. Preferably a legal size folder that contains two inside page dividers. There should be a two hole punch at the top that contains metal file holders. This is where the DUI Attorney needs to keep everything related to the clients case. It should be broken up into six sections.

File notes: The first page should be notes that are kept during the case. This should include any time spent doing work on the case (i.e., review discovery, calling the prosecution, etc). It also should contain notes on your legal strategies and different legal issues that may arise or are identified. This is the building blocks for any pretrial motions in the future.

Correspondence from Court: This section includes notice given for new court dates. Any motions that are filed with the Court (i.e., motion to continue, motion to suppress evidence). It also includes any orders the Judge signs in the case (i.e., order setting trial, order set conditions of release, etc). This should be near the front for easy access

DOL: In any DUI case there most likely will also be an action with the Department of Licensing suspending the clients drivers license. This is its only legal action so it should be treated separately from the criminal matter. This section should contain everything received, and or filed with DOL.

Police report: This section should contain the police report, and any other witness statements received from the Prosecution. In a DUI case this is the main piece of discovery received.

Correspondence with Prosecution: More often than not you're meeting with a Prosecutor many times on a DUI case. Its important to get things in writing. Always print off any emails from the Prosecutor, just in case they don't remember.

Investigation: This section should contain several things. A transcript of any interviews that were done on the arresting officer. Also if an investigator or expert has been employed a copy of their report should go in this section.

The most difficult thing about preparing for trial is organizing all of these materials into a trial notebook. By maintaining distinct sections in your clients folder, these materials are more easily identified and can be included in the trial notebook with relative ease.
