Seems Like Everyone Is a Bankruptcy Attorney

In today's economy the number of individuals filing bankruptcy continues to rise right alongside the number of bankruptcy attorneys. Let's face it, many attorneys are opportunists and when they saw the need, they felt it necessary to fill it. I suppose there is nothing wrong with that as long as they take the time to educate themselves on the topic of filing bankruptcy. There have been some complaints online of people getting a bankruptcy attorney that they later find out specialized in personal injury. They wanted to capitalize on a large number of Americans filing for bankruptcy. Many figure that a bankruptcy filing is simple and basic and all they need is a law degree to represent someone.

Bankruptcy has become a very specialized field, especially since the changes to the bankruptcy code back in 2005. With the bankruptcy law changing constantly, an attorney has to be on top of these changes to be able to represent their client and get the most benefit out of the bankruptcy filing. I guess it goes back to the old adage even in bankruptcy, "You get what you pay for."

Back in 2005, Congress felt it necessary to amend the bankruptcy code and stop Americans from abusing the bankruptcy system. They felt many Americans were capable of paying back at least a portion of their debt and many of them were just plain old serial bankruptcy filers. With the changes to the bankruptcy code, it became apparent that individuals filing bankruptcy should be represented by a bankruptcy attorney. At this time, I don't think anyone knew what was in the near future for America. In late 2007, the wheels started falling off of the US financial system. It took the housing market and just about every other industry with it causing a large number of companies to end up filing bankruptcy and lay off millions of employees. Housing prices quickly declined, leaving many homeowners upside down on what they believed was their nest egg.

Unemployed and no way out, these folks rushed to the Internet and anywhere else they can get information on fixing their financial dilemma. With big changes to the bankruptcy code, Americans quickly found out that filing bankruptcy on their own was no longer a good idea. This is when bankruptcy attorneys got slammed with large numbers of people interested in filing. When housing sales were good, it seemed like just about everyone had a real estate license. I guess it's no different when you're an attorney, when many folks are interested in bankruptcy filing, change your hat to that of a bankruptcy attorney.

When someone is filing bankruptcy they should take the time to find a bankruptcy attorney that will work well with them. It's always nice to find someone that has been practicing law for a long enough period of time to have some experience. Just like everything else, experience breeds good results. When it comes to bankruptcy, it's no different as their attorneys that have practiced for a long time will know the local bankruptcy trustee and bankruptcy judge. This will give them a leg up on what to expect and what's required for the debtor to get a successful bankruptcy discharge.
